Why device rules are important
- Safety: non-compliant devices may not meet safety standards. This could put you and others at risk.
- So you don’t cause interference: non-compliant devices can cause interference to other electronic devices. This can include mobile phones, GPS devices and emergency services equipment.
- Ensuring quality and that the device works in Australia: non-complaint devices often break or don’t work. Don’t waste your money on them.
- You’ll break the law and face penalties: if you are found with a non-compliant device, maximum penalties may include a fine of up to $495,000 or 2 years prison. Penalties may also apply If you are found to be causing significant interference to others, maximum penalties may include a fine of up to $1,650,000 or 5 years prison.

Before you SELL a device
If you sell a radiocommunications device – online or by post or in person – you are considered a seller. This means the same laws apply to you that also apply to larger retailers.
