The issue
Many of the spectrum licences that underpin mobile phone services, parts of the NBN, and that support certain rail networks and television production services, are due to expire between 2028 and 2032.
The ACMA has undertaken an extensive consultation process on the renewal of ESLs. As part of that process, we published our preferred views on pricing paper (the preferred views paper) in May 2026.
In the preferred views paper, we indicated that the benchmark datasets for later expiring bands would be updated prior to the relevant renewal application period in order to incorporate more recent spectrum awards. This approach helps ensure that ESL renewal prices continue to reflect contemporary market conditions.
Given the pricing methodology was settled through the preferred views paper, the principal focus of this consultation is implementation of the process for updating benchmark data in the period leading up to each band’s renewal application period.
This consultation seeks feedback on the proposed framework for implementing future benchmark updates, including:
- the identification, assessment and incorporation of new benchmark observations
- updates to data inputs used in the currency conversion process
- a minor refinement to the application of indexation
- the methodology and timing for population projections to be used in spectrum access charges (SACs)
- the timing and duration of band-specific consultations on updated $/MHz/pop prices.
Feedback received through this consultation will help inform the ACMA’s approach to future benchmark updates and associated renewal pricing decisions.
