Proposal to remake the Public Telecommunication Services Licence Condition Determination and the Cellular Mobile Telecommunication Devices Class Licence

These instruments are due to sunset. As there are synergies between them, we are reviewing both at the same time. We want to remake these instruments with some changes.

The issue

Under Part 4, Chapter 3 of the Legislation Act 2003, most legislative instruments ‘sunset’. They are automatically repealed on either 1 April or 1 October, depending on which date comes first 10 years after they are registered.

The Radiocommunications Licence Conditions (PTS Licence) Determination 2013 and Radiocommunications (Cellular Mobile Telecommunications Devices) Class Licence 2014 are due to sunset on 1 April 2024 and 1 April 2025, respectively. We believe these instruments form a necessary and useful part of the regulatory framework. We propose to remake them with some changes.

As part of the remaking of the sunsetting instruments, we are also proposing associated amendments to the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 (the RRL Determination). These amendments are to enable defined transmitter stations operating under a PTS licence not to be registered on the RRL.
