Key documents

The issue

Under Part 4, Chapter 3 of the Legislation Act 2003, most legislative instruments ‘sunset’. They are automatically repealed on either 1 April or 1 October, depending on which date comes first 10 years after they are registered.

Legislative instruments linked to the technical framework for the 2.3 GHz spectrum licence band are due to sunset on 1 April 2024.

We believe these instruments form a necessary and useful part of the regulatory framework. We propose to remake them with some changes.

Details of the proposed changes and reasoning are outlined in the consultation paper. Copies of the new draft instruments are also available in the key documents box.

Please email freqplan@acma.gov.au with any enquiries.
