Background summary

This consultation seeks comment on the proposal by the Australian Communications and Media Authority (the ACMA) to:

  • remake the Radiocommunications (Emergency Locating Devices) Class Licence 2006 (the Emergency Locating Devices Class Licence)
  • amend the Radiocommunications (Interpretation) Determination 2015 (the Interpretation Determination) in a related respect.

The draft class licence, the Radiocommunications (Emergency Locating Devices) Class Licence 2016, revokes the current Radiocommunications (Emergency Locating Devices) Class Licence 2006.

Issues for comment

The ACMA will carefully consider any submissions received on issues raised in this paper before remaking the Emergency Locating Devices Class Licence. The ACMA will not provide a formal response to submissions but will, in general, publish all submissions it receives.

Emergency Locating Devices Class Licence

The ACMA considers that the Emergency Locating Devices Class Licence continues to form a necessary and useful part of the legislative framework. Accordingly, the ACMA proposes to remake the Emergency Locating Devices Class Licence in a new instrument before the sunset date of 1 October 2016 without any significant changes, so that its ongoing effect is preserved.

Interpretation Determination

The ACMA considers that it is necessary to amend the definition of the COSPAS-SARSAT System in the Interpretation Determination.

Issue 1—Emergency Locating Devices Class Licence

The ACMA welcomes comments from affected stakeholders on its proposal to remake the Emergency Locating Devices Class Licence with the proposed minor amendments, and without any significant changes, on the basis that it is operating effectively and efficiently.

The ACMA welcomes comments from affected stakeholders on its proposal to amend the Interpretation Determination.
