Outcome
On 5 March 2020, the ACMA made the Telecommunications (Emergency Call Service) Amendment Determination 2020 (No.1) to address two issues raised by the Senate Standing Committee for the Scrutiny of Delegated Legislation.
The issue
We want to amend the Telecommunications (Emergency Call Service) Determination 2019 (ECS Determination). This is to fix issues raised by the Senate Standing Committee for the Scrutiny of Delegated Legislation. The issues are:
- the incorporation of documents by reference which are not available to the public
- the use of ‘no-invalidity’ clauses

The ACMA welcomes comments on the proposed amendments set out in the draft Telecommunications (Emergency Call Service) Amendment Determination 2020 (No. 1) and the consultation paper. These include:
- repealing sections which refer to documents not available to the public
- replacing these with sections which impose obligations that achieve equivalent outcomes
- repealing the no-invalidity clauses
