Statement on subscription television and foreign ownership rules


The ACMA regulates ‘pay-TV’ in Australia under Part 7 of the Broadcasting Services Act 1992 (the BSA) relating to subscription television broadcasting licences. Section 95 of the BSA provides that a subscription television licensee must be a company registered in Australia under the Corporations Act 2001. 

The Foxtel licences are held by the following Australian registered companies: Foxtel Cable Television Pty Ltd, Selectra Pty Ltd and Vinatech Pty Ltd. There is no prohibition on foreign persons owning licensee companies for subscription television services. Accordingly, Foxtel is not required to advise the ACMA of any change of ownership of the licensee companies.
