CRA commences public consultation on draft new gambling advertising code of practice

Commercial Radio Australia (CRA) has released for public comment draft new code of practice provisions for commercial radio concerning the promotion of gambling and betting odds in live sports coverage. They have been developed following an announcement by the Minister for Communications and the Arts, Senator the Hon Mitch Fifield on 6 May 2017, of further restrictions on gambling advertising in live sporting events across all platforms.

Public consultation is a key step in the code development process and the Australian Communications and Media Authority therefore strongly encourages all interested stakeholders to review the consultation package and to make a submission to CRA.

Further information about the draft new code and how to make a submission is available from CRA on its website: http://www.commercialradio.com.au/

When a new code is submitted by CRA for registration, the ACMA must register the code if it is satisfied that:

>   the code provides appropriate community safeguards for the matters contained in the code;

>   members of the public have had an adequate opportunity to comment on the code; and

>   the code is endorsed by a majority of the providers of commercial broadcasting services.

In deciding whether the new code provides appropriate community safeguards, the ACMA may consider a range of matters including: the outcomes of the public consultation, its own research and other evidence.
