Facilities Installation – Network Facilities
Telecommunications facilities are governed by legislation at local, state or Commonwealth government level, depending on the type and dimensions of the facility and the zoning of the site.
The installation of telecommunications facilities specified in the Telecommunications Act 1997 (the Act), or in a Ministerial determination made under the Act, are exempt from specified state and territory laws.
Specified facilities can be installed by licensed carriers despite state or territory laws about town planning, use of land, tenancy and fuel and power supply. Telecommunications facilities not covered by the Act or the Telecommunications (Low-Impact Facilities) Determination 1997 are likely to need approval under state or territory law, usually administered at the local government level.
