Allied Construction penalised for calling numbers on the Do Not Call Register

Solar power business Allied Construction and Roofing Pty Ltd has paid a $21,600 infringement notice for calling numbers on the Do Not Call Register without consent.

This follows an investigation by the Australian Communications and Media Authority into consumer complaints about the company’s’ telemarketing practices.

‘The ACMA has been targeting telemarketing practices in the solar industry, following a high number of complaints from consumers. This is the second investigation finalised under this campaign in recent months,’ said ACMA Chair, Nerida O’Loughlin.

‘The rules are simple: telemarketers must not call any number on the register without consent. Non-compliant players in the industry needs to lift their game and respect the preferences of consumers,’ Ms. O’Loughlin added.

The ACMA has a range of enforcement actions it can take where businesses have been found breaking the rules, including seeking a civil penalty and/or injunctions from the Federal Court; giving an infringement notice; accepting a court enforceable undertaking; or issuing a formal warning.

In this case, the ACMA also accepted a court enforceable undertaking from the business detailing its commitment to comply with Australia’s telemarketing laws In addition to the payment of the infringement notice.

The ACMA named telemarketing in the solar industry as a priority compliance area for 2017-18.
