The public comment period for the ACMA’s consultation on the ‘Revised identity-checking requirements for prepaid mobile services’ is now closed. The ACMA received eight submissions/comments to this consultation. Five of these submissions and one comment can be accessed from the right hand side index. Two submissions were submitted on a confidential basis.

 

The ACMA will carefully consider the comments and suggestions contained in all of the submissions before revising the identity-checking requirements.

Summary

The ACMA is seeking comment on proposed regulatory changes that aim to improve the identity-checking requirements for prepaid mobile carriage services (prepaid mobile services).

Between November 2015 and July 2016, the ACMA conducted a review of the Telecommunications (Service Provider – Identity Checks for Prepaid Mobile Carriage Services) Determination 20131 (the current determination). The review was informed by a joint industry and government agency working group (PWG) established by the ACMA. In August 2016, the ACMA agreed to support all 17 recommendations made by the PWG in its Prepaid Determination Review Working Group Report (the PWG report).

The proposed regulatory changes apply to eight of the 17 recommendations developed by the PWG to improve the effectiveness and efficiency of the current regulatory arrangements. These include addressing some of the practical issues that have arisen during industry’s wide-spread transition away from sighting identification at the time of sale to verifying identity at the time of activation, using other identity verification methods that deliver a higher level of confidence about a person’s identity.

The proposed changes are set out in the draft Telecommunications (Service Provider – Identity Checks for Prepaid Mobile Carriage Services) Determination 2016 (the proposed determination), which is intended to repeal and replace the current determination. The PWG report provides important context for the proposed changes.
