Executive summary

Part 21 of the Telecommunications Act 1997 (the Act) covers the technical regulation of customer equipment and customer cabling. One element of the technical regulation arrangements is the use of ‘certification body statements’. A certification body statement is issued by a certification body, and indicates that an item of telecommunications customer equipment or customer cabling complies with an applicable ACMA technical standard.

Subsection 410(1) of the Act allows the ACMA to determine that a specified person or association is an approving body for the purposes of section 410 of the Act. Subsequent to this, subsection 410(2) allows an approving body to determine that a specified person or association is a certification body for the purposes of Division 7 of Part 21 of the Act.

Certification bodies are specified persons or associations that, in the opinion of an approving body, have the necessary skills and experience to certify that telecommunications customer equipment or customer cabling, complies with applicable ACMA technical standards. Under the Telecommunications (Approving Bodies) Determination 2007, there is only one approving body, being the officer holding a particular position within the ACMA, and only that person can determine that a particular person or association is a certification body.

The ACMA is proposing to make a new determination to revoke the Telecommunications (Approving Bodies) Determination 2007, and to specify the Joint Accreditation System of Australia and New Zealand (JAS-ANZ) as an approving body for the purposes of section 410 of the Act.

The ACMA believes that JAS-ANZ has the relevant expertise to make determinations that a specified person or association is a certification body, and the capacity to ensure a high level of competence in certification bodies. In the ACMA’s view, specifying JAS-ANZ as an approving body will increase industry involvement in the ACMA’s technical regulation arrangements, as well as promoting the overall integrity of these arrangements.

Issues for comment

The ACMA invites comments on:

  1. the proposal of the ACMA to make a determination that:
      • revokes the Telecommunications (Approving Bodies) Determination 2007
      • specifies JAS-ANZ as an approving body under subsection 410(1) of the Telecommunications Act 1997
  2. the proposed arrangements for the assessment of applications to a certification body, and for the operation of certification bodies, which are described in the draft Telecommunications Equipment Certification Scheme at Attachment A.
