Telecommunications facilities can be governed by legislation at the local, state or Commonwealth government levels, depending on the type and dimensions of the facility and the zoning of the site.
The installation of telecommunications facilities that are specified in the Telecommunications Act 1997 (the Act), or in a Ministerial determination made under the Act, is exempt from specified state and territory laws. Specified facilities can be installed by licensed carriers despite state or territory laws about town planning, use of land, tenancy and fuel and power supply.
Telecommunications facilities that are not covered by the Act or the Telecommunications (Low-Impact Facilities) Determination 1997 are likely to require approval under state or territory law, usually administered at the local government level.
