Amendments to the regulatory arrangements for the auctioning of Smartnumbers® ACMA is proposing to amend the regulatory arrangements for auctioning smartnumbers® which are contained in:
These amendments are intended to improve the efficiency of the auction system and clarify the current regulatory arrangements. The following discussion paper outlines the current administrative issues and proposed regulatory amendments. It also assesses several approaches to addressing these deficiencies and details the recommended options. The draft guidelines set out the matters that ACMA will take into account in making enforcement decisions, and the principles ACMA proposes to apply in using some of its broadcasting enforcement powers. ACMA is seeking feedback that will contribute to the clarity and practicability of the Request for Tender. ACMA seeks comments on a Radio Quiet Zone for Western Australia ACMA has released a spectrum planning discussion paper seeking stakeholder views on a proposed Radio Quiet Zone (RQZ) for Western Australia. The responses to the paper will be used by ACMA to finalise the scope of the RQZ, and to refine regulatory measures to enforce it. The paper provides background information on the drivers for the proposed RQZ, and describes its scope and expected implementation scheme. A summary of the technical rationale behind the dimensioning of the RQZ is also included in the paper. The RQZ is intended to be an area where existing and future levels of man-made radio-frequency signals are low enough to be compatible with the successful operation of radio astronomy facilities. The zone would be an area where consultation and collaboration is practised to achieve this compatibility before radio-frequency generating activities are carried out, rather than an area where such activities are necessarily excluded. ACMA seeks comments on the future use of unassigned television channels (March 2006) Public consultation on the paper is now closed. Public submissions are available above. ACMA has released a discussion paper on potential uses for two 7 MHz unassigned television channels. The paper examines issues surrounding the allocation of these television channels which were originally planned for datacasting services during planning for digital television. The government is considering whether to allow an expanded range of services to operate on these channels. ACMA is seeking comments on issues including:

ACMA seeks comment on an application from Hutchison Telecommunications (Australia) Ltd for an exemption from providing local number portability ACMA staff are seeking comment on an application (RTF - 1.3 mb or PDF - 76 kb) that has been received from Hutchison Telecommunications (Australia) Limited (HTAL). The application relates to HTAL's LocalZone product which is offered on the Orange (2G CDMA) network. HTAL is seeking an exemption from the requirement to provide local number portability. The purpose of the consultation is to ensure that ACMA is aware of, and considers, all relevant issues prior to forming a view and subsequently, making a decision on the application. ACMA seeks comments on demand and future spectrum requirements for wireless access services ACMA has released a spectrum planning discussion paper to stimulate discussion and solicit information and stakeholder views to gauge the spectrum demands of evolving and future wireless access services (WAS). The responses to the paper will be used by ACMA to guide the development of short, medium and long-term spectrum strategies to support the development and deployment of WAS across Australia. The paper provides information about wireless access demand drivers, international trends and current WAS bands and initiatives. The existing licensing frameworks and their relative merits are discussed. A number of frequency bands with the potential to support future wireless access are identified. A candidate ‘private park’ regulatory framework is outlined, providing a potentially feasible alternative for managing spectrum access of future WAS applications. The paper also provides information on relevant spectrum sharing and incumbent issues. As part of the consultation process ACMA is hosting the Wireless Spectrum Strategies 2006 seminar to be held in Sydney on 6 and 7 March 2006. Details of the seminar can be found here. This consultation process represents only the initial step in the wireless access spectrum planning process. Any subsequent spectrum re-farming or other action arising from ACMA consideration of responses to this paper will be subject to further detailed consultation with stakeholders and potentially affected incumbent licensees. Proposal to amend the Radiocommunications Act 1992 ACMA has prepared a discussion paper on a proposal to amend the Radiocommunications Act 1992 (the Act) to allow class licences to be issued in spectrum designated to be spectrum licensed under section 36 of the Act. Under the proposal, spectrum licensees will be separately consulted if spectrum being considered for class licensing is included in spectrum covered by their spectrum licence. Under the Act parts of the spectrum may be "set aside" for spectrum licensing in two ways. Under section 36 of the Act specified parts of the spectrum may be designated to be allocated by issuing spectrum licences. Under section 153B of the Act spectrum may be declared as subject to re-allocation by issuing either apparatus or spectrum licences. A class licence may be issued in spectrum re-allocated under the section 153B arrangements. However, the operation of section 138 of the Act prevents ACMA from issuing class licences in spectrum designated, under section 36 of the Act, to be allocated by issuing spectrum licences.
