Online complaint process

  1. Complaint submitted via www.acma.gov.au/hotline - if an email address is provided, a confirmation email with a unique reference number is sent to the complainant.
  2. Hotline staff will commence an investigation into the specific URL(s) and, or content details provided and will assess the content according to the National Classification Scheme.
  3. If content is classified or assessed as not being prohibited or potentially prohibited content the investigation will be finalised and the complainant (if they have provided contact details) will be notified of the outcome of the investigation.
  4. If the content is classified or assessed as being prohibited or potentially prohibited content a trace will be made to identify where the content is hosted from.
  5. Overseas hosted content:
If the trace confirms the content is not hosted in Australia, the ACMA refers the content to Internet Industry Association accredited user opt-in Family Friendly Filters in accordance with the industry codes of practice.

If the content consists of child abuse material, the ACMA will also refer the content to the International Association of Internet Hotlines (INHOPE) for referral to the hotline available in the host country. If the country where the content appears to be hosted does not have a hotline, then the content is referred to the Australian Federal Police.
  6. Australian hosted content:
If the trace confirms the content is hosted in Australia the content will be submitted to the Classification Board for classification.

If the classification by the Classification Board falls into a prohibited classification category the ACMA will issue a final take-down notice and direct the content host or service provider to remove the content.

If the content is classified as consisting of child abuse material or other illegal material such as terrorist material, the ACMA, prior to taking any action, will refer the matter to the relevant state or territory law enforcement agency. The ACMA investigation will be suspended pending advice from enforcement that it is okay to precede without compromising a police investigation.
  7. Once an investigation is finalised the complainant (if they have provided contact details) will be notified of the outcome of the investigation.
